3.01 Much of the material covered in this book deals with orthodox principles of private international law. A surprising number of questions will still be encountered for which no authoritative answer has yet been devised; and in looking for these answers we will keep returning to the question of whether an agreement as to jurisdiction, or as to choice of law, is a term of a contract, and if so, of which contract?
