This chapter explains Article 3 of the Rome I Regulation entitled ‘Freedom of Choice’ (Liberté de choix/Freie Rechtswahl). The article is the cornerstone of the Rome Convention, reiterated in the Rome I Regulation, and requires that the choice freely made by the parties as regards the law applicable to their contractual relationship be respected.
