7.01 This chapter examines which ‘goods’ can be the object of a sales contract. All legal systems generally define ‘Contract of Sale’1 as reciprocal exchange of goods against the price2 or at least establish obligations of the parties which allow for that definition.3 However, a definition of the concept of ‘goods’ or ‘things’ is far less common.4 Some legal systems rather exclude items from the sphere of application of their respective sale of goods provisions, thus choosing a negative definition of what can be the object of a sales contract.5 7.02 Although the...
