This chapter provides an overview of conflict of laws and international jurisdiction for private law claims resulting from capital market offences. Although both areas are harmonized in the Rome II Regulation (864/2007/EC) and the Brussels I bis Regulation (2012/1215/EU), the rules in these Regulations are not specifically tailored to capital market information liability, which leads to a number of interesting problems. This section analyses the current status of international jurisdiction and conflict of laws for capital market information liability and examines the scope left for choice of court and choice of law agreements.
