This chapter details the provisions of Article 38. Article 38 establishes the obligation for the Commission to submit a report to the European Parliament and to the Council on the application of the Market Abuse Regulation, which must be fulfilled by 3 July 2019. Article 38(a) to (e) sets out the topic which must be addressed in that report. In addition, Article notes that, for the purposes of point (a) of the first subparagraph, the European Securities and Markets Authority (ESMA) will undertake a mapping exercise of the application of administrative sanctions and lay down criminal sanctions as referred to in Article 30 for infringements of this Regulation, and of the application of such criminal sanctions within Member States. That exercise will also include any data made available under Article 33(1) and (2).
