Exclusion or limit of liability — Insurance

This chapter discusses each of the exclusions included in the Bermuda Form (Articles IV.A–IV.P). It shows that some are unique to this form, some are virtually identical to exclusions typically in use in the United States, and some are hybrids, including similarities and differences from those usually seen in that environment. Some of these exclusions frequently become the source of disputes between policyholders and insurers, and those will be discussed in depth. Others, frequently present in one version or another in many policies other than the Bermuda Form rarely emerge as the source of an actual dispute, still more rarely result in published opinions interpreting them. Less attention will be paid to these.
