Termination of agency

This chapter considers both how agencies come to be terminated and the effects of termination of agency. It notes ordinary course of events between principal and agent, wherein an agency will come to an end because the parties so wish it. It also refers to parties whose legal relations derive from agreement that are at liberty to release one another from their obligations. The chapter emphasizes how an agency may be terminated by operation of law if the contract between principal and agent is frustrated or if the principal loses legal capacity through death or supervening mental incapacity. It examines the effects of termination, wherein the rules that obtain at common law to reimburse agents apply to commercial agents operating under the Commercial Agents (Council Directive) Regulations 1993.
