Choice-of-court Agreements under the European and International Instruments - Online Update, September 2015: The Revised Brussels I Regulation, the Lugano Convention, and the Hague Convention

Abstract

The Hague Convention on Choice of Court Agreements came into force on 1 October 2015. This online-only update considers the changes that the Convention will introduce, as well as recent case law affecting choice-of court agreements considered in the original text. The Convention, while excluding insurance contracts in general, makes a number of significant exceptions to this category in the interests of consumer and business protection, which this online-only update reviews in detail. The update also considers recent cases and developments in jurisdiction, asymmetric choice-of-court agreements, potential benefits to third parties, electronic communications, and damages for unlawful litigation.
